Floor Crossing Fiasco: PDP Sues Osun Lawmakers in APC

The Peoples Democratic Party (PDP) has asked the Federal High Court in Abuja to sack four federal lawmakers from Osun State for defecting from the party to the All Progressives Congress (APC).

Those affected are Senators Francis Adenigba Fadahunsi (Osun East) and Olubiyi Oluwole Fadeyi (Osun Central), as well as House of Representatives members Omirin Emmanuel Olusanya (Atakumosa East/West, Ilesa East/West) and Taofeek Abimbola Ajilesoro (Ife Federal Constituency).

In four separate suits filed by its counsel, Raphael Oyewole, the PDP argued that their defection breached Section 68(1)(g) of the 1999 Constitution (as amended), which bars lawmakers from abandoning the party that sponsored their election unless there is a division or merger within it.

The party is seeking a declaration that the lawmakers’ seats are vacant by operation of law and an order compelling Senate President Godswill Akpabio and House Speaker Tajudeen Abbas to declare them vacant. It also asked the court to direct the Independent National Electoral Commission (INEC) to conduct by-elections in the affected districts and constituencies.

Additionally, the PDP is demanding that the lawmakers refund all salaries, allowances, and benefits received since their defection, while ordering the Clerk of the National Assembly to halt further payments to them.

The case, marked FHC/ABJ/CS/1725/2025, FHC/ABJ/CS/1728/2025, FHC/ABJ/CS/1727/2025, and FHC/ABJ/CS/1726/2025, was filed on August 20 and is yet to be assigned to a judge.

This development comes weeks after the PDP’s Osun chapter also dragged Rep. Oluwole Oke to court over a similar defection, vowing to enforce constitutional provisions against political cross-carpeting.
